Fishkill to tax School Taxes


WHEREAS, in the course of its budget review process, the 2012 Town Board determined thatthe Town of Fishkill expends substantial sums of money for the assessment of real property within the Town, the collection of school taxes and the defense of tax certiorari litigation which have been borne solely by the Town of Fishkill in the past; and

              WHEREAS, New York State Town Law §37(1), in relevant part, authorizes the Town Board to,by resolution, authorize the Receiver of Taxes and Assessments to receive taxes for thirty (30) days after the first day specified in the notice for payment of set taxes at charge not more than one per centum(1%) upon such taxes anto further authorizeby resolution, the Receiver of Taxes and Assessments to receive taxes heretofore payable to the school district's collectors after the expiration of such thirty (30) day period together with a fee not more than five per centum (5%) upon such taxes as the Town Boardshall determine and specify in such resolution; and

              WHEREAS, the Town of Fishkill previously charged back mailing and other expense to theschool district but this charge will not be included within the collection fee; and

              NOW, THEREFORE, BE IT RESOLVED, that Resolution              of 2012 hereby authorizesand directs the Town Receiver of Taxes and Assessments, commencing with the 2013 school district tax collection cycle, to receive school district taxes for sixty (60) days after the first day specified in the notice for the payment of such taxes at a fee of four tenths of one per centum (.4%) of the amount of such taxes;and

              BE IT FURTHER RESOLVED, that the Town Clerk is directed to send a copy of this resolution to the Receiver of Taxes and Assessments, the Wappinger Central School District and the Dutchess County Department of Finance, Office of Real Property Tax Services.
